1. General

The website www.tenson.com and the online shop available on the website (jointly the “Website”) is operated by Tenson AB (“we”, “us” or “Tenson”), a Swedish limited liability company with its registered office at Femvägsskälet 2, SE-421 50 Göteborg, Sweden, Reg. No. 559327-2650, VAT No. SE559327265001.

These Terms and Conditions (these “Terms”) apply to all purchases made by consumers on the Website. By visiting the Website and/or placing an order on the Website, you confirm that you make this purchase in the capacity as consumer and accept and agree to the contents of these Terms. Please make sure you have read and understood these Terms before placing an order.

We reserve the right to change these Terms without notice by posting revised Terms on the Website. Each order will be governed by the version of the Terms posted on the Website at the time you place your order. We may also change the content on the Website without prior notice.

These Terms do not in any way limit your statutory rights as a consumer. In case of a discrepancy between these Terms and statutory law, you may always rely on the provisions of statutory law.

2. Orders and Payments

When you place an order, you will receive an e-mail confirming receipt of your order. This e-mail only confirms that your order has been received by us and will not constitute acceptance of your order. The actual contract is not concluded until your payment has been approved and the order has been processed and we send a confirmation e-mail to you. We reserve the right not to accept your order for any reason. Further, we reserve the right to cancel an accepted order if the product you ordered is out of stock, your billing information is incorrect, we cannot deliver to the address you have provided, the price for the product was incorrectly displayed on the Website, we have reason to believe that your order is fraudulent, due to an event of Force Majeure (see below) or if the customer has acted in bad faith (e.g. incorrect information that the customer was or should have been aware of, such as incorrect price information).

If we deny or cancel your order, we will contact you and, if possible, do our best to offer you an alternative solution.

When you have placed an order and it has been accepted in our systems, it may be technically difficult for us to annul or change it. If you change your mind or need to cancel your order for any reason, please contact our customer service and make sure you have your order number available. We will do our best to assist you, but please be aware that you may have to accept delivery of your order and return it to us if you change your mind after your order has been accepted.

We offer safe payments through encrypted payment solutions provided by our payment solution partners Adyen. The payment methods available to you may vary depending on your country of purchase.

3. Prices and VAT

All prices on the Website are inclusive of value added tax (VAT) and exclusive of delivery costs. The applicable VAT rate vary depending on your country of purchase. We follow the regulations of OSS (One stop shop).

We reserve the right to change the prices on the Website without notice.

4. Shipping and Delivery

All orders placed on the Website are shipped from Tenson’s warehouse in Västra Frölunda, Sweden. We ship orders every working day and aim to deliver your purchase as quickly as possible. Delivery times will vary depending on where you live, and the estimated delivery time will be stated in the checkout process and your order confirmation e-mail.

In order to avoid delivery delays, make sure to submit correct billing and shipping information. All orders are sent with tracked delivery and you will be able to follow your shipment through the tracking number included in the confirmation e-mail we send to you. If you have any questions regarding your shipment or need help to track your order, please contact our customer service.

Delivery costs and methods may vary depending on your country of purchase and may be subject to changes (e.g. in case of promotions).

Delivery cost and method:

  • Sweden - Postnord - 49 SEK

  • European - UPS - 4 EUR

  • Denmark - UPS - 35 DKK

The actual delivery cost and method applicable to your purchase may differ from the table and will be clearly displayed during the checkout process prior to finalizing your order.

Unclaimed shipments will be returned to Tenson and you will be charged the actual costs for shipping and return.

5. Defective Goods

You are entitled to return goods which, upon delivery, are defective or not in conformity with your order. In case you receive defective goods, you need to contact us and inform us of the defect as soon as possible, however not later than two months after you noticed (or should have noticed) the defect.

Tenson remains liable to you for any defects or lack of conformity which exists at the time when the goods were delivered and which becomes apparent within three years (or such shorter period of time that is stated by statutory law in your country of purchase) of that time. Unless proved otherwise, any lack of conformity which becomes apparent within six months of delivery (or such longer period of time that is stated by statutory law in your country of purchase) of the goods shall be presumed to have existed at the time of delivery unless this presumption is incompatible with the nature of the goods or the nature of the lack of conformity.

If you return goods which you deem defective, we will examine the goods and – if we agree that the goods are defective – either repair or replace the goods or refund you the purchase price.

Your return is free of charge, provided that you use the pre-paid return label and follow the instructions that are enclosed with your shipment. Delivery of replacement goods will be made free of charge.

6. Force Majeure

Tenson shall not be liable for delays or failure to perform any obligations when the failure is caused by circumstances beyond our reasonable control, including but not limited to flood, fire, earthquake or other natural disasters, strike or other labor disputes, accidents, epidemics, pandemics, war, civil commotion or unrest, acts or threated acts of terrorism or acts of government or governmental regulation (events of “Force Majeure”).

We will contact you in case an event of Force Majeure occurs that affects our possibility to perform our obligations towards you. If your delivery of goods is affected by the Force Majeure event, we will re-schedule delivery to a date as soon as possible after the event of Force Majeure is over. Alternatively, you may cancel the purchase by giving us notice thereof.

8. Governing Law

These Terms, and purchases made on the Website, are governed by substantive Swedish law, excluding its choice of law principles and the applicability of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
